Legal basis of the prohibition<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ca43fa7 elementor-widget elementor-widget-text-editor\" data-id=\"ca43fa7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The installation of cameras inside the property constitutes <strong>permanent and unjustified surveillance of identified or identifiable persons<\/strong>, which violates various legal provisions:<\/span><\/p><p><b>a) Regulation (EU) 2016\/679 (GDPR)<\/b><\/p><ul><li><span style=\"font-weight: 400;\"><strong>Article 5.1.c (Data minimisation)<\/strong>: processing must be \u201cadequate, relevant and limited to what is necessary.\u201d The continuous recording of the interior of an accommodation clearly exceeds this limitation.<\/span><\/li><li><span style=\"font-weight: 400;\"><strong>Article 6.1 (Lawfulness of processing)<\/strong>: there is no valid legal basis that legitimises video surveillance in private areas where guests enjoy their personal, intimate and domestic life.<\/span><\/li><li><span style=\"font-weight: 400;\"><strong>Article 7 (Consent)<\/strong>: guests\u2019 consent cannot be considered freely given or valid, as it occurs in a context of imbalance between owner and tenant.<\/span><\/li><li><span style=\"font-weight: 400;\"><strong>Article 9 (Special categories of data)<\/strong>: video recording could capture particularly sensitive data (health, beliefs, sexual orientation\u2026) in spaces where individuals have the highest expectation of privacy.<br \/><br \/><\/span><\/li><\/ul><p><b>b) Organic Law 3\/2018 (LOPDGDD)<\/b><b><br \/><\/b><\/p><ul><li><span style=\"font-weight: 400;\"><strong>Article 22 (Processing for video surveillance purposes)<\/strong>: requires that video surveillance be limited to spaces strictly necessary for the intended purpose. The interior of dwellings is not considered a legitimate space for this type of processing.<\/span><\/li><li><span style=\"font-weight: 400;\">The Spanish Data Protection Agency (AEPD) has reiterated through <strong>sanctioning resolutions<\/strong> (for example, PS\/00477\/2022 and PS\/00003\/2023) that <strong>it is not permissible to install cameras inside dwellings intended for rental<\/strong>, even when they are switched off.<br \/><br \/><\/span><\/li><\/ul><p><b>c) Fundamental rights<\/b><b><br \/><\/b><\/p><ul><li><span style=\"font-weight: 400;\"><strong>Article 18.1 and 18.4 of the Spanish Constitution<\/strong>: protection of personal and family privacy and data protection.<\/span><\/li><li><span style=\"font-weight: 400;\">The expectation of privacy inside a dwelling is absolute.<\/span><\/li><\/ul><p>\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-887aa99 elementor-widget elementor-widget-heading\" data-id=\"887aa99\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">2. Scope of the prohibition<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-64af2ca elementor-widget elementor-widget-text-editor\" data-id=\"64af2ca\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The installation of cameras is prohibited, even if they are \u201cdisconnected,\u201d in:<\/span><\/p><ul><li><span style=\"font-weight: 400;\">Living rooms<\/span><\/li><li><span style=\"font-weight: 400;\">Bedrooms<\/span><\/li><li><span style=\"font-weight: 400;\">Kitchens<\/span><\/li><li><span style=\"font-weight: 400;\">Bathrooms<\/span><\/li><li><span style=\"font-weight: 400;\">Any other interior area of the property<br \/><br \/><\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">The mere <strong>physical presence<\/strong> of recording devices already constitutes a violation of guests\u2019 rights, as declared by the Spanish Data Protection Agency.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8582633 elementor-widget elementor-widget-heading\" data-id=\"8582633\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">3. Consequences of non-compliance\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-8ceeb4d e-flex e-con-boxed e-con e-parent\" data-id=\"8ceeb4d\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-080325d elementor-widget elementor-widget-text-editor\" data-id=\"080325d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Failure to comply with these regulations may entail:<\/span><\/p><ul><li><span style=\"font-weight: 400;\">Administrative fines of up to <strong>20 million euros or 4% of the annual turnover<\/strong> (Art. 83 GDPR).<\/span><\/li><li><span style=\"font-weight: 400;\">Specific sanctions under the LOPDGDD of up to <strong>\u20ac300,000<\/strong> for serious infringements.<\/span><\/li><li><span style=\"font-weight: 400;\">Reputational damage, civil claims and withdrawal of tourist licences.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6b0e4f1 elementor-widget elementor-widget-heading\" data-id=\"6b0e4f1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">4.
